Pensioner sues police over damage to her signed picture of Hitler

A pensioner has lost a battle for compensation from the police over allegations that they damaged her signed photograph of Adolf Hitler, it was revealed today.

Dorothy Phillips, 77, from Clandown, near Bath, took Avon and Somerset Police to court three times over claims about the ruined photo, which they seized during an investigation connected to her son.

Mrs Phillips valued the photo at £10,000 and believes it faded while it was held at Bath police station as evidence.

During the search of her house in November 2006, officers confiscated the photograph along with some Romanov cufflinks, flags and books on SS members.

The case was dropped and in January of this year Avon and Somerset Police accepted the search and seizure of property had been illegal and awarded £7,500 compensation to the Phillips family.

But Mrs Phillips was unhappy with the state in which the photograph was returned, claiming it knocked £5,000 of its value and sought compensation at Bristol County Court sitting before Judge Bursell.

She has twice before sought compensation, but was unable to provide evidence proving the depreciation in value.

Judge Bursell ordered Mrs Phillips pay a total of £1,716 in costs towards Avon and Somerset Police for bringing the three separate hearings, but he said if she ever found expert evidence of the value of the damage caused to the photo, she would have grounds to appeal.

Avon and Somerset Police did not want to comment today on the case.

Wanted gangster 'paid detective cocaine, cash and call-girls for information'

A gangster wanted for murder paid a detective for secret information in cocaine, cash and call-girls, a court heard today.

Detective Constable John Jones was accused of taking £2,000 a week from career criminal Allan Foster, who cold-bloodedly executed a drug dealing associate.

The officer repeatedly accessed the Northumbria Police intelligence computer to find out what fellow officers knew about Foster, then passed it on, the jury heard.

Toby Hedworth QC, prosecuting, said on one occasion in April 2006 Jones and Foster travelled from the North East to London's West End, where they visited nightclubs, hired call-girls and snorted cocaine.

They took calls from the Prada shop in Chelsea as they travelled down to London and visited the shop, then were picked up by a limousine driver who took them to bars and clubs, including Stringfellows and the Knightsbridge private members' club The Wellington.

Then the gangster took the married police officer to a mews house in Kensington which Foster was renting, and call-girls were brought, Newcastle Crown Court heard.

Mr Hedworth said: 'These sex workers will give evidence before you I anticipate, including the fact both men were snorting cocaine to the extent that DC Jones was unable to take advantage of the favours bought for him.'

He said: 'You may think Allan Foster had a taste for the high life, but Detective Constable Jones liked the flavour as well.

'What, you may ask yourself, was this officer doing to be rewarded in such a way by a man who he will have known to be an active professional, criminal.'

The court heard Jones developed a contact with Foster in 2003 through Bruce McCall, a friend of the officer who owned a gym where all three men worked out.

Foster was facing a lengthy prison sentence for importing cannabis and wanted to gain credit from the judge by passing on information.

As an official informant he was given a shorter sentence, after he tipped off police about a cache of guns which they found in a car parked in Plaistow, east London.

Jones passed on the contact to colleagues working for the National Crime Squad, who tried to develop him further as an informant.

That should have been the end of formal dealings between Jones and Foster, the court heard, but the policeman continued to associate with him and pass on information.

After the murder of South Tyneside drug dealer David "Noddy" Rice in 2006, Northumbria Police uncovered the link between their officer and the gangster, the court heard.

Mr Hedworth said: 'He was, and still is, believed to have cold-bloodedly murdered one of his criminal associates, a man known as David "Noddy" Rice.'

The jury heard Foster was able to stay "one step ahead" of the authorities and spirited himself out from the country. Foster was based in Sunderland and is now believed to be in Spain.

The court heard an associate of Foster would give evidence to say that Jones took a bundle of £2,000 cash every week from the criminal when they met at the gym.

The 48-year-old detective denies three counts of public misconduct.

Body builder McCall, 42, denies one count of aiding and abetting public misconduct, and counts relating to the importation, supply and possession of illegal steroids.

Sex offender expert must wait for sentence over child porn

A PROBATION Service expert who distributed child pornography while setting up a £10m Home Office database of sex offenders will have to wait a further two weeks to be sentenced.Vincent Barron, of Kirk Rise, Frosterley, County Durham, sent ten pornographic images of children to a Scottish man he met in an internet chatroom.Barron, 49, pleaded guilty to the offences and was due to be sentenced at Kirkcaldy Sheriff Court yesterday. However, the court was told that Barron's solicitor was detained with another matter in Edinburgh and the case was deferred for a fortnight.Twice-married Barron pleaded guilty in December last year to distributing indecent pictures of children aged between five and 12, between May and August 2005. At the time, he was earning £45,000 a year as an assistant chief probation officer seconded to the Home Office to establish the Violent and Sex Offender Register (ViSOR). The database tells police forces how many registered sex offenders and dangerous criminals live in their area and what crimes they have committed. Barron was arrested after officers from Fife Constabulary searched the computer of a local man who was being investigated in a separate case. Police found that ten indecent images of children on the Fife man's PC had been sent from Barron during online conversations. During a police interview, Barron admitted he had used internet chatrooms to exchange pornographic photographs of children. He said his curiosity had been aroused after hearing through his job how easy it was to find pornography online, adding he felt "so guilty and so ashamed".A spokesman for Northumbria Probation Board said at the time: "As a consequence of police investigations, an employee of Northumbria Probation Board seconded to the National Offender Management Service was dismissed. "We are unable to make any further comment at this time."

DC Hywel Jones, 45, sold information through Barry Wise ? the uncle of former England footballer Dennis Wise. He used the national police database to pass on details of police suspects to his criminal clients. The dad-of-two, of Ruislip, West London provided updates of probes and revealed licence plate numbers of undercover cars. Officers became suspicious when the Met officer sent confidential emails from work to his home in 2003. During an intensive 14 month surveillance operation Jones’ car was bugged, he was placed under surveillance and his phone records were monitored by detectives.

Police defend drowning death case

Police chiefs have defended two community support officers (PCSOs) who did not enter the water as a 10-year-old boy drowned in a pond.
Jordon Lyon leapt into the water in Wigan, Greater Manchester, after his eight-year-old stepsister Bethany got into difficulties on 3 May.
Two anglers jumped in and saved Bethany but Jordon became submerged.
The inquest into his death heard the PCSOs did not rescue him as they were not trained to deal with the incident.
Jordon was playing at the edge of the pond, known locally as John Pit, off Wigan Lower Road, in Standish Lower Ground, with his two brothers, stepbrother and stepsister on 3 May.
He was trying to support Bethany as she struggled in the six-feet-deep water before slipping from view.
Anglers managed to pull Bethany out but Jordon was out of sight before they could get to him.
The alarm was raised and the PCSOs arrived on the scene. Police said they could see no sign of Jordon in the water, so they radioed trained officers for help.
Greater Manchester Police said an officer was on the scene within five minutes.
Members of Jordon's family also rushed to the scene to join the search.
He was eventually pulled from the pond but despite attempts to resuscitate him he was later pronounced dead in hospital.
A verdict of accidental death was recorded.
His mother, Tracy Ganderton, and stepfather Anthony, of Bluebell Avenue, Wigan, are demanding to know why the PCSOs did not try to rescue Jordon and why they did not give evidence at the inquest held by deputy West Manchester coroner Alan Walsh.
Mr Ganderton told the inquest: "I don't know why they didn't go in. I can't understand it.
"If I had been walking along a canal and seen a child drowning I would have jumped in.
"You don't have to be trained to jump in after a drowning child."


Mrs Ganderton said on Friday that the PCSOs in question should be named.
"If you're walking down the street and you see a child drowning you automatically go in that water.
"You don't care if you're going to lose your job or not, you don't care do you?
"I want them to be named. I want to know why they didn't go in, I want to know why they weren't at the inquest when I had to turn up there, and go through the pain of it all.
"I want to know why they didn't have to be there as main witnesses.
"They should have to be there. They shouldn't have a job."
In a statement after the hearing, Det Ch Insp Phil Owen, of Wigan CID, who led the investigation into Jordon's death, said: "PCSOs are not trained to deal with major incidents such as this.
"Both ourselves and the fire brigade regularly warn the public of the dangers of going into unknown stretches of water so it would have been inappropriate for PCSOs, who are not trained in water rescue, to enter the pond.
"This was a tragic incident where a young boy lost his life and we would once again want to pass on our heartfelt condolences to Jordon's family."


'Life-saving skills'
Paul Kelly, chairman of the Police Federation in Manchester, said PCSOs do not have the same level of training as police officers to deal with life-saving situations.
He said: "The message is clear and unambiguous - it's the government, they are trying to fool the public.
"They take a person and dress him up as a police officer but they just don't have the same powers.
"Every single police officer I trained with left training school with a life-saving certificate of some sort."
He said the PCSOs might not have been able to swim and in that case they should not have risked their lives.
But he added: "People throw themselves into rivers and ponds to save people every day because it's the right thing to do.
"This is an accident waiting to happen again."
West Lancashire Coroner Jennifer Leeming said: "Neither myself or the Deputy Coroner can comment on individual cases but the statement put out by Greater Manchester Police reflects the evidence that was given in the courtroom."

Child porn sergeant escapes jail

A former Dyfed-Powys Police sergeant whose estranged fiancée reported him to colleagues, has been spared jail after admitting possessing child pornography.
Mark Bretherick's former partner had discovered he used internet child porn sites, Swansea Crown Court was told.
The 33-year-old, from near Welshpool, received a three-year supervision order after the judge was shown the image.
He was also put on the sex offenders register for five years and will have to complete a sex offenders programme.
Judge Christopher Morton decided Bretherick was not a danger to the public.
Bretherick had admitted a charge of possessing an indecent image of a child in September on the eve of a jury trial.
At the same hearing it was directed that 17 other charges should all remain on file.
It came after the prosecution acknowledged the impossibility of proving the images were downloaded after a change in the law.
Until January 11 2001, the possession of such indecent images of children were only dealt with by magistrates courts.
After that date the change meant that they were dealt with only in crown courts.
Had they been downloaded before the change in the law it would have been necessary to start a prosecution within six months.
Jim Davis, prosecuting, told the court on Friday the images were found on two laptops in Bretherick's possession.
One of the two laptops held just one image which it could be clearly proved had been downloaded after the law change.
Mr Davis told how the police were alerted to Bretherick's activities by his estranged fiancée.
She had been packing up her things in the house they had shared in December 2005 after they had decided to separate when she had discovered documents in Bretherick's handwriting listing illicit websites, he said.
"As a result of finding that document the police were informed and his laptops seized," Mr Davis said.
"An indecent thumbnail photograph was found on a Rock laptop, but it showed that the full-size photograph had been on the laptop at some time.
"The full image itself had been deleted."
Bretherick - who had been based at Newtown - had voluntarily resigned from his job and felt only "deep deep shame", the court heard.
Michael Mather-Lees, defending, said: "He is very much a shadow of the former Mark Bretherick.
"He wants, through me, to express his apologies and shame for himself and what he has brought on others."
